FitLivingFoodies.Com offers a variety of services, including a website, health and fitness content, social networking components – including but not limited to discussion forums and community groups – and other health and fitness related products and services, including select promotional offers (hereinafter “Services”), some of which you may not have access to.  

AGREEMENT BY YOU

By accessing, using or downloading any of the Services, you agree to follow and be bound by these Terms of Use (hereinafter “Terms”) which may be updated by from time to time without notice to you. FitLivingFoodies.Com and its third party providers may make improvements and/or changes to the Services at any time without notice. If the reader of the agreement is a parent or guardian entering this agreement for the benefit of a child over 13, then he or she agrees and accepts full responsibility for his or her child’s use of FitLivingFoodies.Com and the Services, including all financial charges and legal liability that such child may incur.   FITLIVINGFOODIES.COM RESERVES THE RIGHT AT ANY TIME AND FROM TIME TO TIME TO MODIFY OR DISCONTINUE, TEMPORARILY OR PERMANENTLY, THE SERVICES OR ANY PORTION THEREOF WITH OR WITHOUT NOTICE. YOU AGREE THAT FITLIVINGFOODIES.COM SHALL NOT BE LIABLE TO YOU OR TO ANY THIRD PARTY FOR ANY MODIFICATION, SUSPENSION OR DISCONTINUANCE OF THE SERVICES OR ANY PORTION THEREOF.   If you do not agree with the Terms, please do not use the Services. BY CONTINUING TO USE THE SERVICES, YOU ARE INDICATING YOUR AGREEMENT TO THE TERMS AND ALL REVISIONS THEREOF. BY USING FITLIVINGFOODIES.COM OR THE SERVICES, YOU THEREFORE AGREE, REPRESENT AND WARRANT THAT:

  • YOU ARE 13 YEARS OR OLDER BUT UNDER THE AGE OF 18 AND YOU HAVE REVIEWED AND CONSENTED TO THE TERMS WITH YOUR PARENTS PER; OR
  • YOU ARE 18 YEARS OR OLDER; AND HAVE CONSENTED TO AND AGREED TO THE TERMS; AND
  • YOU HAVE RECEIVED CONSENT FROM YOUR PHYSICIAN TO PARTICIPATE IN NUTRITION, HEALTH AND FITNESS PROGRAMS, WORKOUTS, EXERCISES, OR ANY OTHER RELATED ACTIVITIES ASSOCIATED WITH THE SERVICES.

  FURTHER, YOU ACKNOWLEDGE AND AGREE THAT FITLIVINGFOODIES.COM HAS OFFERED THE SERVICES IN RELIANCE UPON THE WARRANTY DISCLAIMERS, RELEASES AND LIMITATIONS OF LIABILITY SET FORTH IN THE TERMS. YOU ALSO ACKNOWLEDGE AND AGREE THAT THESE WARRANTY DISCLAIMERS, RELEASES AND LIMITATIONS OF LIABILITY REFLECT A REASONABLE AND FAIR ALLOCATION OF RISK BETWEEN YOU AND FITLIVINGFOODIES.COM, AND THAT THESE WARRANTY DISCLAIMERS, RELEASES AND LIMITATIONS OF LIABILITY FORM AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN YOU AND FITLIVINGFOODIES.COM. FITLIVINGFOODIES.COM WOULD NOT BE ABLE TO PROVIDE THE SERVICES TO YOU ON AN ECONOMICALLY REASONABLE BASIS WITHOUT THESE WARRANTY DISCLAIMERS, RELEASES AND LIMITATIONS OF LIABILITY. OWNERSHIP AND PROPRIETARY RIGHTS   The Services are owned and operated by FitLivingFoodies.Com. You acknowledge and agree that the Services and any FitLivingFoodies.Com content offered as part of the Services contain copyrighted information that is protected by applicable intellectual property and other laws. Except as expressly permitted by applicable law or authorized by FitLivingFoodies.Com or applicable third party service providers or advertisers, you agree not to modify, rent, lease, loan, sell, distribute or create derivative works based on the Services or any content offered as part of the Services in whole or in part. FitLivingFoodies.Com grants you a personal, non-transferable and non-exclusive right and license to access and use the Services; provided that you do not (and do not allow any third party to) copy, modify, create a derivative work from, sell, assign, sublicense, or otherwise transfer any right in the Services.   The term FitLivingFoodies.Com along with any associated logos and names of the specific Services are the exclusive trademarks of, and are owned by FitLivingFoodies.Com, and you may not use or display such trademarks in any manner without FitLivingFoodies.Com prior written permission. Any third party trademarks or service marks displayed via the Services are the property of their respective owners. FitLivingFoodies.Com reserves all rights not expressly granted hereunder.

ADDITIONAL REQUIREMENTS
